Iemand verweet mij dat ik niet helder genoeg schrijf, anders waren die perverse afpersingspraktijken allang opgepikt door de pers. Nou, draag zelf dan je steentje bij en deel je ervaring denk ik dan. Het probleem is juist dat de pers met ANP en DPG Media onderdeel is van de auteursrechtlobby en volop meedoet met het afdwingen van buitenproportionele schadevergoedingen. En dan ook nog op een wijze dat de fotograaf er nauwelijks wat van terugziet. Daarvoor loopt dus al jaren deze petitie...
Semantius.nl
Internet waar internet ooit voor bedoeld was! Voor wie zich wil verweren en jurisprudentie zoekt is er nu de slimme zoekmachine voor gerechtelijke uitspraken: Semantius. Met van elke uitspraak een (leken)samenvatting gemaakt met ai. Foute aannames en verdraaiingen van rechters zitten niet langer meer verstopt in wollige stukken vol vakjargon.
Fairlicensing
Helaas worden de opspoor- en beheertools voor fototrollen ook steeds geavanceerder. Een vrij nieuwe speler is Fairlicensing. Onder andere ANP en Alamy gebruiken de tool. De tool stuurt phishing mailtjes en probeert je te laten inloggen en een peperdure licentie aan te smeren. Als je reageert blijkt het ineens een schikkingsvoorstel te zijn voor een inbreuk en wordt er gedreigd met gerechtelijke stappen. Het beste negeer je zolang het mails zijn. Want het maakt niet uit hoe goed je verweer is, ze blijven een bewijs van onschuld eisen. Je komt in een geautomatiseerd incassotraject terecht met reacties van een ai-bot.
ANP Holding BV
Trouwe lezers weten dat ik de herroepingszaak verloren heb omdat ik de verkeerde rechtspersoon had gedagvaard, ik daagde de werkmaatschappij van ANP. De procedure wordt vervolgd met de rechtsopvolger van Hollandse Hoogte BV: dat bleek ANP Holding BV. Blijkbaar is die naamgeving een vermomming want de claims van de afdeling Fairlicensing worden dus verstuurd vanuit ANP Holding BV. Kan ik mooi meenemen in de lopende zaak, dat ANP Holding BV de praktijken van Hollandse Hoogte BV voortzet.
Tuchtklacht
Goed om te zien dat er nog steeds dappere dodo’s zijn die de strijd met de auteursrechtlobby aangaan. Er is een klacht ingediend tegen een Nederlandse advocaat die een claim van een buitenlandse fototrol overnam. Ik vermoed dat die trol Copytrack is. De klacht is afgewezen. Ik vind dat schandalig maar dat zal de trouwe lezer niet verwonderen. Als iemand de naam van de advocaat weet? Dan zet ik het erbij, een desinfecterend zonnetje is het enige middel dat ik heb.
Regelrechter
Er is een laagdrempelige wijze van procederen bijgekomen: de regelrechter. Kwestie van digitaal een formulier invullen, een deurwaarder is niet nodig. Er wordt dan een hoorzitting gelast die bedoeld is om te schikken. Dat lijkt op de commissie waar deze petitie om verzoekt! Nu nog iemand die het aandurft!
Overigens probeert de rechtspraak eenvoudige fotogeschillen al jarenlang laagdrempelig op te lossen. Je mag zelf een brief naar de rechter sturen, een jurist is niet verplicht als je gedaagd wordt. En vaak gelast de rechter ook nu al een zitting om te schikken. Fototrollen weten dat en dagen alleen de ‘inkoppertjes’ voor de rechter; de mensen waarvan ze weten dat die zich niet goed kunnen verweren. Ze gaan echt niet iemand met een goed verweer voor de rechter slepen. Met de regelrechter kun je nu terug dreigen. Een fototrol wil uiteraard niet naar de rechter met zaken waar de kans groot is dat hij verliest.
Autoriteit Consument en Markt
Ooit nam de ACM contact met mij op over de afpersingspraktijken met fotorechten en ik gaf ze alle informatie waar ze om verzochten. Lange tijd dacht ik dat ze bezig waren met een onderzoek en dat ze de fototrollen aan zouden pakken. Totdat ik hun hulp in een schrijnende zaak inriep. Mijn kafka-ervaring deelde ik op LinkedIn en ik liet het verder rusten. Een zaak met een lelijke fototrol, conceptdagvaarding met meer dan € 5.000 schade voor een futiliteit, was echter aanleiding om maar weer eens een melding te doen. In plaats van hulp kreeg ik een mailtje dat het niet tot hun takenpakket behoorde. En tot mijn schrik krijgen nieuwe melders nu een zelfde soort bericht. Waar hebben we in hemelsnaam zo’n duur instituut als de ACM voor?
Voorlopig moet ik dus nog even door met aan de bel trekken en slachtoffers helpen… Geen ambtenaar te vinden die wil helpen, laat staan dat er opgetreden wordt.
Teken en deel de petitie! Deel je ervaringen online. Een desinfecterend zonnetje is hard nodig met een pers die onderdeel is van het probleem.

Urgent Action Needed: End the Plight of Sudanese Asylum Seekers in the Netherlands Amid Ongoing Crisis and War in Sudan"

Allow us to start with the warnings issued by international organisations that Sudan will suffer an unimaginable humanitarian catastrophe if the ongoing war does not stop permanently.
The intense fighting is putting the lives, safety, and security of civilians at grave risk all over Sudan. The new escalation in violence is exacerbating an already devastating situation and making people desperately need urgent help. At least more than 500 people have died and thousands injured since the power struggle between Sudan's army and paramilitary group Rapid Support Forces (RSF) descended into fighting almost four weeks ago.
The fighting has pushed Sudan's population to near breaking point, with food becoming scarce, electricity cut off and many hospitals shut down. To make things worse, multiple aid agencies have suspended operations, and the United Nations High Commissioner for Refugees (UNHCR) said it was gearing up for potentially tens of thousands of people including children, women, and the elderly, fleeing to neighbouring countries.
The UN refugee agency also stated that “the ongoing brutal conflict has forced more than 100,000 Sudanese Refugees to flee neighboring countries, and at least 20,000 Sudanese refugees to flee to Chad from Darfur”, which it describes as “one of the regions most affected by violence of Sudan, and where growing instability might cause much larger displacement in the coming weeks.”
Regrettably, the situation in Sudan remains volatile. There are no positive signs on the horizon about an imminent end to the fighting, and people in Sudan are still living in fear every single day. Bodies are scattered in the streets, children, and women are among the victims. It seems the voice of bullets has prevailed over the voice of wisdom, sanity and the sanctity of our homeland and the safety of its citizens.
The signatories believes that the dilemma of the transitional period lies in the existence of multiple heads of power and decision-making centres. In addition, the de facto authority is neither elected nor decentralized and is unable to take decisive decisions. We are particularly saddened that once again, avaricious, and power-hungry men have trampled upon the needs and wishes of Sudanese people.
In the face of this tragic scene, the world watched with interest how the concerned countries hastened to evacuate their diplomatic missions and nationals from Sudan, which left an impression among many that the crisis is likely to deteriorate rapidly.
However, we are particularly saddened to see these countries racing to evacuate their nationals from Sudan, while they stand by and watch the catastrophic scene in this country. The paradox here is that the majority of these countries provide support to the two warring parties, the army and the Rapid Support Forces, in accordance with their interests. We are also shocked to learn that some of these countries have ruled out introducing safe and legal routes for Sudanese fleeing the war to seek asylum in their soil.
The signatories strongly believes that the relevant Dutch authorities should grant all Sudanese asylum seekers the right to settle immediately and without any conditions under their applicable legislations, and in the light of the ongoing war in Sudan.
Those unfortunate people and their families have endured years of uncertainty and are traumatized as a result, let alone the psychological, emotional, and financial problems they are experiencing. Many suffer from panic attacks, nightmares, and psychological problems due to the long wait for decisions regarding their asylum applications.
Undoubtedly, the ongoing war in their country, the lack of security and basics elements of normal life for the citizens there and the constant concern for the safety of their families have exacerbated the suffering of these people and made their psychological and mental conditions worse than ever.
We hereby strongly appeal to your esteemed administration to take the necessary measures to end the plight of Sudanese asylum seekers, their long suffering and grant them asylum to prove that the Netherlands is at the forefront of sponsoring countries for refugees fleeing repression and persecution in their country in search of safe havens.
