Ik maakte hem destijds aan in de verwachting dat ie opgepikt zou worden door politiek en pers. Én om een punt te zetten achter mijn pogingen om de misstanden onder de aandacht te brengen. Hoe anders is dat gelopen.
Mijn eigen zaak
De derde procedure start 14 oktober en ik leverde de stukken in bij de rechtbank. Mijn eisen (het vonnis uit 2019 herroepen wegens bedrog) blijven ongewijzigd. Ik heb recente ontwikkelingen toegevoegd; als achtergrondschets en om nogmaals te benadrukken dat ik de procedure niet voer uit eigen belang. Een uitgebreide update vind je bij de inzamelingsactie.
Die andere inzamelingsactie
Van de aangifte van smaad en laster door de persoon die 15.000 euro inzamelt voor een rechtszaak tegen ANP hoorde ik, zoals ik verwachtte, niets meer. Helaas bleef het qua de beloofde media-aandacht voor de praktijken van ANP eveneens stil. Terwijl dat zo ontzettend hard nodig is. Vervelend neveneffect van het merkwaardige doel (een rechtszaak aanspannen om de tijd die je besteed hebt aan het verweer terug te vorderen) is dat het aantal meldingen over Fairlicensing van ANP weer toenam. Mensen denken dat de kosten enorm oplopen als je niet betaalt en durven de phishing mailtjes niet te negeren. Ik herhaal dus nog meer eens dat het misleidende aanbiedingen zijn.
Van het tableau geschrapt
Twee advocaten die ik met naam noem in het stuk over fototrol Nico Trinkhaus zijn geen advocaat meer. Of ze vrijwillig terugtraden is mij niet bekend. Kitty van Boven, die samen met Roel Dijkstra de brief schreef die aanleiding was voor deze petitie, heeft nog steeds haar kantoor. De tweede geschrapte advocaat vertrok wel bij het kantoor waar ze werkte. Helaas zijn de blafbrieven van Clairfort daarmee niet gestopt, ze worden nu alleen ondertekend door een andere advocaat.
Status tweede wapperzaak
Ik treed als gemachtigde op in een zaak waar hetzelfde speelt als bij mijn eigen zaak: ANP wappert met het auteursrecht van een freelance fotograaf. Inmiddels zijn er vier zittingen geweest, is er één vonnis gewezen (doorverwijzing naar andere rechtbank), heb ik dezelfde stukken tweemaal in gediend, heeft mijn cliënte de machtiging voor een derde keer moeten opsturen en heb ik daar nog achteraan moeten bellen voordat ik gekoppeld was als gemachtigde. Wij zijn nu aan de beurt om te reageren op het antwoord (repliek) van ANP. Ik ben die kafkaëske toestanden en het geblaf van Gerechtsdeurwaarders Rosmalen gewend, voor mijn cliënte is het enorm stressvol. We duimen voor een rechter die doorziet dat het ooit zo respectabele persbureau ANP de rechten van aangesloten freelancers misbruikt.
Rechtszaak Pictoright versus Meta
Het leek zo’n nobel streven, de campagne van de federatie Beeldrechten, om Meta te laten betalen voor het hergebruik van je beeldmateriaal. Maar het is verzand in een slepende procedure waar deskundigen zijn aangewezen die maar liefst een voorschot krijgen van € 676.813,50. Met het risico dat Pictoright, mocht blijken dat zij helemaal geen overeenkomst kán afsluiten met Meta, opdraait voor de kosten van die deskundigen. Mijns inziens is zo’n overeenkomst voorbehouden aan de uitgevers (artikel 7b WNR) en Pictoright is geen uitgever maar een beheerorganisatie. Ik begrijp niet dat de rechtbank daar niet eerst een beslissing over nam, dan had dat hele deskundigenonderzoek misschien achterwege kunnen blijven.
Embedden
Het schrijven van een boek over fotorecht levert inzichten op. Onze Auteurswet is nog gebaseerd op een analoge werkelijkheid. Waardoor niet duidelijk is wat wel en niet mag als je foto’s met een link deelt. Meest hardnekkige misverstand is dat iedereen denkt dat ‘automatisch embedden’ mag en zich niet realiseert dat daarbij een aanklikbare bronvermelding is vereist. Het is net zoals met het begrip citeren: het mag, mits je voldoet aan bepaalde voorwaarden. De zoektocht naar de juiste uitleg leverde drie blogjes op: nummer 35, met een filmpje en de verwerking voor het boek.
Thuiskopie, reprorecht, UvO en Pictoright
Ik deed, met wat hulp van Gemini, research naar de wettelijk verplichte vergoedingen voor hergebruik van foto’s. Ik checkte onder andere jaarrekeningen van organisaties die de vergoedingen innen en uitkeren aan fotografen. Een groot deel gaat op aan ‘kosten’ en uitgevers blijken een aanzienlijk deel te ontvangen. Slechts een kleine groep fotografen ontvangt een uitkering, en dan ook nog alleen voor foto’s die in de pers verschenen. En net toen ik van die ontdekking bekomen was (ik laat het rusten en hoop dat anderen dat onderwerp oppakken) diende de volgende kwestie zich aan:
Vordering van bijna drie ton voor fotobureau
Een Nederlands fotobureau, wiens naam angstvallig wordt verzwegen, claimde vermoedelijk onrechtmatig namens fotografen collectieve vergoedingen. En hoe herkenbaar voor mij, Pictoright schrijft er het volgende over: “Het betreffende fotobureau heeft bij Pictoright claims ingediend voor collectieve rechtenvergoedingen, maar heeft niet aangetoond dat het beeldmateriaal waarover door Pictoright informatie is verzocht, daadwerkelijk is gepubliceerd. Ook de vragen, over de bevoegdheid van het fotobureau om deze claims namens fotografen in te dienen en de doorbetaling aan fotografen, zijn door dit bureau niet afdoende beantwoord.” Omdat de pers het niet oppikt heb ik wel zo’n donkerbruin vermoeden welk fotobureau het betreft. Sowieso is het opmerkelijk dat Pictoright uitkeert aan fotobureaus, haar taak is verdelen van vergoedingen over de rechthebbenden. Rechthebbend is een fotobureau dat werkt met freelancers niet. Dat beeldbanken en fotobureaus de rechten niet bezitten is nou precies waarom die sommatiebrieven uit naam van ANP, Reuters, Alamy, Getty, Masterfile niet deugen.
Workshop
Iemand vroeg of ik workshops over auteursrecht gaf. Aanleiding was dat twee collega’s van hem zo’n workshop wilde gaan volgen bij ANP en hij vreesde dat ze daar niet zouden leren hoe om te gaan met de blafbrieven van fototrollen. Die vrees deel ik dus ik heb ja gezegd. Als het goed bevalt ga ik, als het boek af is, misschien wel weerbaarheidstrainingen tegen fototrollen geven. Kan ik best een ‘billijke vergoeding’ voor vragen denk ik, want het aantal onredelijke fotoclaims blijft stijgen, dus dan heb je het snel terugverdiend…

Het probleem met deze zin is dat we met alle informatie nu blind moeten vertrouwen of de tekst wel of niet gegenereerd is door de computer of door een mens.
Op LinkedIn betrap ik nu al heel vaak dat teksten niet van de mensen afkomt die ik in eerste instantie volg. Mensen die eerst 3 zinnen tekst schreven en nu uit het niets hele essays posten. Gevolg, als ik het niet vertrouw stop ik met lezen. En daar zit het gevaar. Gebrek aan vertrouwen,achterdochtig zijn en je ogen sluiten. En dat is problematisch voor toekomstige communicatie.
Nieuwsupdate. Deze week kwam naar buiten dat "the godfather of ai" nu vraagt om de ontwikkeling te remmen. https://nos.nl/artikel/2473634-godfather-van-kunstmatige-intelligentie-verlaat-google-en-waarschuwt-voor-ai ondanks deze nieuwsartikelen zie ik weinig schot in de zaak.
Ik wordt er een beetje moedeloos van, ook als ik merk dat mensen nog blind zijn voor de problemen die het met zich mee kan gaan brengen, het komt vaak dat mensen het niet begrijpen. Ik moest mijn moeder stap voor stap laten zien wat de software kon. We moeten mensen boven uitleggen en laten zien wat de voordelen en nadelen kunnen zijn.
Met dat laatste heb ik hulp nodig, deze boodschap kan ik niet alleen overbrengen, dat zullen we allemaal moeten doen. Alleen dan kan deze petitie kans van slagen hebben

Betaald parkeren is uitgesteld door zorgen van bewoners, bedrijven en overige instellingen. Maar dit betekent niet dat de strijd is gestreden. Uitstel is namelijk geen afstel! Dit toont wel degelijk aan dat we samen een verschil kunnen maken. Wie er nog niet in gelooft is hopelijk nu wel overtuigd. Steun de petitie en laten we samen met een beter plan komen!

Urgent Action Needed: End the Plight of Sudanese Asylum Seekers in the Netherlands Amid Ongoing Crisis and War in Sudan"

Allow us to start with the warnings issued by international organisations that Sudan will suffer an unimaginable humanitarian catastrophe if the ongoing war does not stop permanently.
The intense fighting is putting the lives, safety, and security of civilians at grave risk all over Sudan. The new escalation in violence is exacerbating an already devastating situation and making people desperately need urgent help. At least more than 500 people have died and thousands injured since the power struggle between Sudan's army and paramilitary group Rapid Support Forces (RSF) descended into fighting almost four weeks ago.
The fighting has pushed Sudan's population to near breaking point, with food becoming scarce, electricity cut off and many hospitals shut down. To make things worse, multiple aid agencies have suspended operations, and the United Nations High Commissioner for Refugees (UNHCR) said it was gearing up for potentially tens of thousands of people including children, women, and the elderly, fleeing to neighbouring countries.
The UN refugee agency also stated that “the ongoing brutal conflict has forced more than 100,000 Sudanese Refugees to flee neighboring countries, and at least 20,000 Sudanese refugees to flee to Chad from Darfur”, which it describes as “one of the regions most affected by violence of Sudan, and where growing instability might cause much larger displacement in the coming weeks.”
Regrettably, the situation in Sudan remains volatile. There are no positive signs on the horizon about an imminent end to the fighting, and people in Sudan are still living in fear every single day. Bodies are scattered in the streets, children, and women are among the victims. It seems the voice of bullets has prevailed over the voice of wisdom, sanity and the sanctity of our homeland and the safety of its citizens.
The signatories believes that the dilemma of the transitional period lies in the existence of multiple heads of power and decision-making centres. In addition, the de facto authority is neither elected nor decentralized and is unable to take decisive decisions. We are particularly saddened that once again, avaricious, and power-hungry men have trampled upon the needs and wishes of Sudanese people.
In the face of this tragic scene, the world watched with interest how the concerned countries hastened to evacuate their diplomatic missions and nationals from Sudan, which left an impression among many that the crisis is likely to deteriorate rapidly.
However, we are particularly saddened to see these countries racing to evacuate their nationals from Sudan, while they stand by and watch the catastrophic scene in this country. The paradox here is that the majority of these countries provide support to the two warring parties, the army and the Rapid Support Forces, in accordance with their interests. We are also shocked to learn that some of these countries have ruled out introducing safe and legal routes for Sudanese fleeing the war to seek asylum in their soil.
The signatories strongly believes that the relevant Dutch authorities should grant all Sudanese asylum seekers the right to settle immediately and without any conditions under their applicable legislations, and in the light of the ongoing war in Sudan.
Those unfortunate people and their families have endured years of uncertainty and are traumatized as a result, let alone the psychological, emotional, and financial problems they are experiencing. Many suffer from panic attacks, nightmares, and psychological problems due to the long wait for decisions regarding their asylum applications.
Undoubtedly, the ongoing war in their country, the lack of security and basics elements of normal life for the citizens there and the constant concern for the safety of their families have exacerbated the suffering of these people and made their psychological and mental conditions worse than ever.
We hereby strongly appeal to your esteemed administration to take the necessary measures to end the plight of Sudanese asylum seekers, their long suffering and grant them asylum to prove that the Netherlands is at the forefront of sponsoring countries for refugees fleeing repression and persecution in their country in search of safe havens.
