Gelijk hebben is nog geen gelijk krijgen bij de rechter…
Mijn verzoek aan de rechter om het vonnis van de legbatterijfoto te herroepen leek mij een te behappen risico. Het ergste dat er kon gebeuren is dat ANP bewijs overlegt waaruit blijkt dat ze uit eigen naam schade mocht vorderen. Zo’n bewijs is er wel of niet en dat kost geen uren om dat uit te zoeken. Ik had ingeschat dat ik bij verlies hooguit €1.000,- aan proceskosten kwijt zou zijn.
‘Je denkt nog steeds dat je gaat winnen hè?’ zei mijn gemachtigde toen hij weken later telefonisch een bericht van de advocaat van ANP doorgaf.
Eerlijk gezegd denk ik dat helemaal niet, ik vrees een achterkamertjesvonnis. Publiciteit kan dat voorkomen, dus het petitie-nieuwsbericht is dit keer geheel gewijd aan het opmerkelijke verloop.
De deurwaarder
De eerste deurwaarder die ik benaderde, zaak aangemeld per mail en paar uur later erachteraan gebeld, weigerde de zaak. Na nog 5 belletjes vond ik pas een deurwaarder.
Hollandse Hoogte B.V. bleek uitgeschreven in het handelsregister. Omdat Hollandse Hoogte al voor mijn rechtszaak was samengegaan met ANP gaf ik telefonisch door dat ANP B.V. gedaagd moest worden. Of ik dat per mail wilde bevestigen zei de deurwaarder. Met de wetenschap van nu had ik de deurwaarder uit moeten laten zoeken wie de rechtsopvolger is van Hollandse Hoogte B.V..
Ik had de deurwaarder opdracht gegeven de zaak aan te brengen bij de rechtbank. Omdat mijn gemachtigde aangaf nog steeds geen factuur voor het griffierecht te hebben ontvangen belde ik naar de rechtbank en kwam ik er zo nog net op tijd achter dat het aanbrengen niet gebeurd was.
De advocaat
Vooropgesteld. Voor het eerst in mijn ‘carrière’ dat ik een fatsoenlijke advocaat tref. Wellicht omdat hij in iets anders gespecialiseerd is dan Intellectueel Eigendom ;-).
De advocaat gaf aan dat de verkeerde rechtspersoon is gedaagd en stelde een ‘verzoeningsgesprek’ voor. Ik heb de advocaat vriendelijk bedankt voor de uitnodiging.
Vervolgens gaf de advocaat aan dat ANP zich zal verzetten tegen wijziging van de rechtspersoon en dat ANP inzet op een volledige proceskostenveroordeling. Of ik de procedure niet beter kon intrekken? Dit keer antwoordde ik kort, NEE.
Het verweer van ANP
Als eerste verweer uiteraard dat de verkeerde rechtspersoon is gedaagd. Dat is een onverwachts kadootje. Er blijkt een hele kerstboom te zijn opgetuigd, zoals mijn gemachtigde het prachtig verwoordde. Door Bas van Beek, mijn inziens het brein van de fototrollerij bij ANP. Hopelijk is dat voor de rechter voldoende reden om mijn verzoek de rechtspersoon te wijzigen te honoreren.
Als tweede verweer dat ik te laat ben met herroepen. Daarna het inhoudelijke verweer.
De eis van een volledige proceskostenveroordeling heeft ANP laten vervallen. Een hele geruststelling dat het me geen godsvermogen gaat kosten als de rechter de zaak niet-ontvankelijk verklaart omdat ik de verkeerde rechtspersoon heb gedaagd.
De rechtbank
Ik had mijn repliek (= de reactie op de verweren) al bijna klaar toen er bericht kwam dat de kantonrechter de zaak wil bespreken in een zitting. In deze fase van de procedure is dat ongebruikelijk en ik verzuchtte tegen mijn gemachtigde: “Tentakels ANP zijn lang”. Hij appte terug: “Die van jou zijn plakkerig haha”.
Met een zitting lopen de proceskosten stevig op en het lijkt me zinloos om het geschil inhoudelijk te bespreken als er nog niet geoordeeld is over de twee niet-inhoudelijke verweren van ANP. We hebben een verzoek ingediend om daar eerst uitspraak over te doen. Mocht de rechtbank dat verzoek niet honoreren neem ik het zekere voor het onzekere. Dan trek ik de zaak in en daag de juiste rechtspersoon.
Privatieve lastgevingsovereenkomst
Er kwam nog een onverwachts kadootje voorbij: Een uitspraak met een andere fototrol. De rechter legt helder uit dat als je een recht niet bezit dat je dat recht alleen op eigen naam uit kunt oefenen met een privatieve lastgevingsovereenkomst, art. 7:423 BW. Vertaald naar fotoclaims betekent dat: Een rechthebbende fotograaf moet opdracht gegeven hebben aan de fototrol om te procederen en tegelijkertijd zijn recht op schadevergoeding opgeven. No way dat een fotograaf dat doet.
Ik weet al langere tijd dat als de rechten nog bij de fotograaf liggen dat een fototrol mede namens de fotograaf schadevergoeding moet vorderen. Het overgrote deel van de onredelijke fotoclaims dat ik onder ogen krijg zijn ermee af te wimpelen. In mijn verweren kan ik dat vanaf nu onderbouwen met het wetboek én jurisprudentie.
Van foto’s van ANP weet je niet of ANP ze bezit of beheert. ANP koopt foto’s aan, ANP had in het verleden fotografen in dienst waardoor ANP automatisch de rechten verwierf en freelancers kunnen de rechten overdragen.
Een rechter weet ook niet of een eiser de rechten bezit. En als je het als gedaagde niet betwist komt het als feit vast te staan. Breng je het wel ter sprake en de eiser blijkt de rechten slechts te beheren, dan win je als het goed is. Maar daarvoor moet je dus een dure jurist inschakelen of zelf juridisch onderlegd zijn. Dat maakt een rechtvaardig vonnis onhaalbaar voor de leek. Zo heeft de van ANP winnende gedaagde meer dan €7.000 uitgegeven aan een advocaat en slechts €150,- vergoed gekregen.
In dit kader: Copytrack heeft blijkbaar een nieuwe client, Yay Images, en heeft massaal sommaties verstuurd. Yay Images is een agency waar fotografen hun rechten behouden. De blafmails van Copytrack namens Yay Images kun je dus gerust negeren.
Wordt vervolgd
Ik heb in ieder geval veel zin in een zitting. Ik hoop dat er te zijner tijd wat mensen mee willen zodat ik niet zoals bijna 6 jaar geleden in mijn eentje tegenover 3 gemachtigden van ANP en een geïrriteerde rechter sta. Herstel, bijna in mijn eentje. Mijn man was destijds mee maar die probeerde me over te halen toch maar te schikken omdat hij meende dat de rechter de wet volgde...

Urgent Action Needed: End the Plight of Sudanese Asylum Seekers in the Netherlands Amid Ongoing Crisis and War in Sudan"

Allow us to start with the warnings issued by international organisations that Sudan will suffer an unimaginable humanitarian catastrophe if the ongoing war does not stop permanently.
The intense fighting is putting the lives, safety, and security of civilians at grave risk all over Sudan. The new escalation in violence is exacerbating an already devastating situation and making people desperately need urgent help. At least more than 500 people have died and thousands injured since the power struggle between Sudan's army and paramilitary group Rapid Support Forces (RSF) descended into fighting almost four weeks ago.
The fighting has pushed Sudan's population to near breaking point, with food becoming scarce, electricity cut off and many hospitals shut down. To make things worse, multiple aid agencies have suspended operations, and the United Nations High Commissioner for Refugees (UNHCR) said it was gearing up for potentially tens of thousands of people including children, women, and the elderly, fleeing to neighbouring countries.
The UN refugee agency also stated that “the ongoing brutal conflict has forced more than 100,000 Sudanese Refugees to flee neighboring countries, and at least 20,000 Sudanese refugees to flee to Chad from Darfur”, which it describes as “one of the regions most affected by violence of Sudan, and where growing instability might cause much larger displacement in the coming weeks.”
Regrettably, the situation in Sudan remains volatile. There are no positive signs on the horizon about an imminent end to the fighting, and people in Sudan are still living in fear every single day. Bodies are scattered in the streets, children, and women are among the victims. It seems the voice of bullets has prevailed over the voice of wisdom, sanity and the sanctity of our homeland and the safety of its citizens.
The signatories believes that the dilemma of the transitional period lies in the existence of multiple heads of power and decision-making centres. In addition, the de facto authority is neither elected nor decentralized and is unable to take decisive decisions. We are particularly saddened that once again, avaricious, and power-hungry men have trampled upon the needs and wishes of Sudanese people.
In the face of this tragic scene, the world watched with interest how the concerned countries hastened to evacuate their diplomatic missions and nationals from Sudan, which left an impression among many that the crisis is likely to deteriorate rapidly.
However, we are particularly saddened to see these countries racing to evacuate their nationals from Sudan, while they stand by and watch the catastrophic scene in this country. The paradox here is that the majority of these countries provide support to the two warring parties, the army and the Rapid Support Forces, in accordance with their interests. We are also shocked to learn that some of these countries have ruled out introducing safe and legal routes for Sudanese fleeing the war to seek asylum in their soil.
The signatories strongly believes that the relevant Dutch authorities should grant all Sudanese asylum seekers the right to settle immediately and without any conditions under their applicable legislations, and in the light of the ongoing war in Sudan.
Those unfortunate people and their families have endured years of uncertainty and are traumatized as a result, let alone the psychological, emotional, and financial problems they are experiencing. Many suffer from panic attacks, nightmares, and psychological problems due to the long wait for decisions regarding their asylum applications.
Undoubtedly, the ongoing war in their country, the lack of security and basics elements of normal life for the citizens there and the constant concern for the safety of their families have exacerbated the suffering of these people and made their psychological and mental conditions worse than ever.
We hereby strongly appeal to your esteemed administration to take the necessary measures to end the plight of Sudanese asylum seekers, their long suffering and grant them asylum to prove that the Netherlands is at the forefront of sponsoring countries for refugees fleeing repression and persecution in their country in search of safe havens.
