Je zou verwachten dat er op een gegeven moment genoeg gewaarschuwd is voor de misleidende mails van fototrollen en dat mensen er niet meer in trappen. Maar er lijken steeds meer fototrollen bij te komen en ze wanen zich onaantastbaar. Wat ook weer niet zo vreemd is met een overheid die handhaving auteursrecht overlaat aan private partijen en weigert op te treden tegen de misleidende praktijken.
De ontwikkelingen van de afgelopen twee maanden:
Kippenfoto-zaak
Mijn derde poging om goede jurisprudentie uit te lokken leek weer vast te lopen in bureaucratisch gedoe. De rechtbank wilde de zaak nogmaals mondeling behandelen maar zegt een tekort aan rechters te hebben en dat het inplannen daarom nog minimaal 6 maanden zal duren. Ik begin zo langzamerhand te vermoeden dat rechtbank Rotterdam gewoon geen trek heeft om een vonnis te wijzen dat ongunstig is voor de status quo wat betreft handhaving fotorechten. Gefrustreerd diende ik een uitgebreide klacht - zie update 2 crowdfunding - in. Met succes dit keer! De hoorzitting is vooralsnog van de baan en de procedure wordt per direct schriftelijk voortgezet. Wordt vervolgd.
Workshop
Ik berichtte de vorige keer dat ik op verzoek een workshop zou gaan geven. Dat was leuk! Achterafgezien had ik eigenlijk niks hoeven voor te bereiden. Ik was voornemens wat uit te leggen over citaatrecht, eigendomsrecht, de verschillende licentievormen enzovoort. Maar het grootste gedeelte van de middag ging over hoe om te gaan met sommatiebrieven. En mijn (te lange) intro over het falen van de rechtspraak en waarom ik doe wat ik doe kan ik een volgende keer overslaan. De problematiek is zonder dat verhaal duidelijk genoeg. Had ik beter sommatiebrieven van deelnemers kunnen bespreken. Als het boek eindelijk af is maar eens een goed plan maken. Dan wordt het een weerbaarheidstraining tegen fototrollen. En voor de theorie kan je dan het boek gebruiken.
Geld genoeg maar niet voor jou
Geweldig boek van Thomas Bollen over hoe private partijen de macht over digitale geldschepping in handen hebben. De overheid leeft nog in het analoge tijdperk, alsof er nog een geldpers is vereist. Voor mij een feest der herkenning. De Auteurswet gaat ook nog uit van ‘in druk verschenen’. Ik heb de overeenkomsten uitgeschreven – klik hier. Het boek gaf mij inzicht hoe lobbymacht werkt en waarom fototrollen straffeloos door kunnen blijven gaan. Het boek is hier te koop.
Pleidooi voor wetsherziening
Het boek van Thomas Bollen deed mij beseffen dat de wet echt radicaal anders moet. En dat de rechtenlobby de Auteurswet met opzet gedateerd lijkt te houden zodat ie weinig houvast biedt in het digitale tijdperk. Da’s goed voor de werkgelegenheid in de sector, kan er lekker geprocedeerd worden over futiliteiten als stockfoto’s. Mijn boek gaat eindigen met 15 aanbevelingen voor de Auteurswet. Het eerste beknopte concept op mijn blog.
Micta
Douglas Mensink van Micta B.V. neemt vastgelopen discussies over van fototrol Rights Control. Hij maakt het wel heel erg bont met zijn conceptdagvaardingen. Dat er weinig van die dagvaardingen deugt blijkt wel uit het feit dat hij met een vordering van 29k naar de kantonrechter wil. De grens voor kanton is namelijk 25k en bij hogere bedrag is bovendien een advocaat verplicht. Mensink is geen advocaat…
Het blijft onbegrijpelijk dat de autoriteiten hier niet tegen optreden. Ik heb cliënten die met de idiote conceptdagvaardingen bij de politie zijn geweest. Die geeft aan dat je hulp moet inschakelen van een advocaat. Ik deed zelf tevergeefs een melding bij de ACM. Als iedereen die een conceptdagvaarding van Micta ontving deze nou eens doorstuurt naar ACM? Link. Of de publiciteit opzoekt?

Ik treed als gemachtigde op in een zaak waar hetzelfde speelt als bij mijn eigen zaak over de kippenfoto: ANP wappert met het auteursrecht van een freelancefotograaf. Ook hier bureaucratisch gedoe: verschoven naar een andere rechtbank; verweer niet gekoppeld; een derde schriftelijke ronde voor ANP. Maar nu volgt er eindelijk uitspraak. Dit jaar nog als het goed is. Al vond ik dit vreemd: “Het kan zijn dat de rechter later uitspraak doet. U krijgt daar dan geen brief over.”
Pictoright
De naam van het fotobureau dat de collectieve vergoedingen van fotografen (vermoedelijk) achterover drukte is bekend gemaakt: BSR Agency. Pictoright heeft inmiddels ook aangifte gedaan. Het blijft wonderlijk dat je hierover verder niks leest in de pers.
Sowieso vind ik het wonderlijk dat Pictoright uitkeert aan fotobureaus. Pictoright is aangewezen om de wettelijke verplichte vergoedingen voor hergebruik van foto’s uit te keren aan de rechthebbenden. Dat ze aan fotobureaus uitkeren komt waarschijnlijk omdat je al je hergebruikrechten exclusief over moet dragen aan Pictoright om in aanmerking te komen voor een vergoeding. En die rechten hebben persfotografen vaak al aan een fotobureau overgedragen. Overigens meldt Pictoright in de jaarrekening dat niet-aangeslotenen hun rechten ook kunnen claimen. Hoe die dat moeten doen is me een raadsel.
De rechtszaak die Pictoright voert met Meta voert zij namens alle aangesloten fotografen. Uit de jaarrekening 2024 kan ik niet opmaken hoeveel rechthebbenden zijn aangesloten. Het lijken er niet veel te zijn gezien het feit dat de meeste fotografen de uitkering dus via een fotobureau ontvangen.
Collectieve vergoedingen is een onderwerp dat ik snel ga laten rusten. Voor mijn boek was ik er even ingedoken, en daar werd ik niet vrolijk van. Ik kwam met een voorzichtige schatting dat 18% van de geïnde collectieve vergoedingen terecht komt bij de maker. Hoe meer je weet, hoe erger het wordt.
Dat was het weer voor deze keer. Volgende keer hoop ik dat ik jullie kan melden dat ANP in beide rechtszaken in het ongelijk is gesteld… En iemand is bezig met een tool waarmee je kunt achterhalen of een foto in het publieke domein staat, een CC-licentie heeft en wie de rechthebbende is. Misschien dan weer eens een positief voortgangsbericht.

Het probleem met deze zin is dat we met alle informatie nu blind moeten vertrouwen of de tekst wel of niet gegenereerd is door de computer of door een mens.
Op LinkedIn betrap ik nu al heel vaak dat teksten niet van de mensen afkomt die ik in eerste instantie volg. Mensen die eerst 3 zinnen tekst schreven en nu uit het niets hele essays posten. Gevolg, als ik het niet vertrouw stop ik met lezen. En daar zit het gevaar. Gebrek aan vertrouwen,achterdochtig zijn en je ogen sluiten. En dat is problematisch voor toekomstige communicatie.
Nieuwsupdate. Deze week kwam naar buiten dat "the godfather of ai" nu vraagt om de ontwikkeling te remmen. https://nos.nl/artikel/2473634-godfather-van-kunstmatige-intelligentie-verlaat-google-en-waarschuwt-voor-ai ondanks deze nieuwsartikelen zie ik weinig schot in de zaak.
Ik wordt er een beetje moedeloos van, ook als ik merk dat mensen nog blind zijn voor de problemen die het met zich mee kan gaan brengen, het komt vaak dat mensen het niet begrijpen. Ik moest mijn moeder stap voor stap laten zien wat de software kon. We moeten mensen boven uitleggen en laten zien wat de voordelen en nadelen kunnen zijn.
Met dat laatste heb ik hulp nodig, deze boodschap kan ik niet alleen overbrengen, dat zullen we allemaal moeten doen. Alleen dan kan deze petitie kans van slagen hebben

Betaald parkeren is uitgesteld door zorgen van bewoners, bedrijven en overige instellingen. Maar dit betekent niet dat de strijd is gestreden. Uitstel is namelijk geen afstel! Dit toont wel degelijk aan dat we samen een verschil kunnen maken. Wie er nog niet in gelooft is hopelijk nu wel overtuigd. Steun de petitie en laten we samen met een beter plan komen!

Urgent Action Needed: End the Plight of Sudanese Asylum Seekers in the Netherlands Amid Ongoing Crisis and War in Sudan"

Allow us to start with the warnings issued by international organisations that Sudan will suffer an unimaginable humanitarian catastrophe if the ongoing war does not stop permanently.
The intense fighting is putting the lives, safety, and security of civilians at grave risk all over Sudan. The new escalation in violence is exacerbating an already devastating situation and making people desperately need urgent help. At least more than 500 people have died and thousands injured since the power struggle between Sudan's army and paramilitary group Rapid Support Forces (RSF) descended into fighting almost four weeks ago.
The fighting has pushed Sudan's population to near breaking point, with food becoming scarce, electricity cut off and many hospitals shut down. To make things worse, multiple aid agencies have suspended operations, and the United Nations High Commissioner for Refugees (UNHCR) said it was gearing up for potentially tens of thousands of people including children, women, and the elderly, fleeing to neighbouring countries.
The UN refugee agency also stated that “the ongoing brutal conflict has forced more than 100,000 Sudanese Refugees to flee neighboring countries, and at least 20,000 Sudanese refugees to flee to Chad from Darfur”, which it describes as “one of the regions most affected by violence of Sudan, and where growing instability might cause much larger displacement in the coming weeks.”
Regrettably, the situation in Sudan remains volatile. There are no positive signs on the horizon about an imminent end to the fighting, and people in Sudan are still living in fear every single day. Bodies are scattered in the streets, children, and women are among the victims. It seems the voice of bullets has prevailed over the voice of wisdom, sanity and the sanctity of our homeland and the safety of its citizens.
The signatories believes that the dilemma of the transitional period lies in the existence of multiple heads of power and decision-making centres. In addition, the de facto authority is neither elected nor decentralized and is unable to take decisive decisions. We are particularly saddened that once again, avaricious, and power-hungry men have trampled upon the needs and wishes of Sudanese people.
In the face of this tragic scene, the world watched with interest how the concerned countries hastened to evacuate their diplomatic missions and nationals from Sudan, which left an impression among many that the crisis is likely to deteriorate rapidly.
However, we are particularly saddened to see these countries racing to evacuate their nationals from Sudan, while they stand by and watch the catastrophic scene in this country. The paradox here is that the majority of these countries provide support to the two warring parties, the army and the Rapid Support Forces, in accordance with their interests. We are also shocked to learn that some of these countries have ruled out introducing safe and legal routes for Sudanese fleeing the war to seek asylum in their soil.
The signatories strongly believes that the relevant Dutch authorities should grant all Sudanese asylum seekers the right to settle immediately and without any conditions under their applicable legislations, and in the light of the ongoing war in Sudan.
Those unfortunate people and their families have endured years of uncertainty and are traumatized as a result, let alone the psychological, emotional, and financial problems they are experiencing. Many suffer from panic attacks, nightmares, and psychological problems due to the long wait for decisions regarding their asylum applications.
Undoubtedly, the ongoing war in their country, the lack of security and basics elements of normal life for the citizens there and the constant concern for the safety of their families have exacerbated the suffering of these people and made their psychological and mental conditions worse than ever.
We hereby strongly appeal to your esteemed administration to take the necessary measures to end the plight of Sudanese asylum seekers, their long suffering and grant them asylum to prove that the Netherlands is at the forefront of sponsoring countries for refugees fleeing repression and persecution in their country in search of safe havens.
